Summary
If you wish to obtain recognition as a manufacturer authorised to submit approval documents, you must first submit your request to the Wallonia Mobility and Infrastructure Public Service – Department of Transport Rules and Regulation – Department of Vehicle Regulation and Certification.

- ‘Manufacturer’ means ‘a natural or legal person who is responsible for all aspects of the type-approval of a vehicle, system, component or separate technical unit, for the individual vehicle approval or the authorisation procedure for parts and equipment, the guarantee of conformity of production (COP), and market surveillance aspects concerning that vehicle, that system, that component, that separate technical unit, that part and that equipment, whether or not that person is directly involved in all stages of the design and construction of the vehicle, system, component or separate technical unit concerned’.
- ‘Technical service’ means ‘an organisation or body designated by the approval authority as a testing laboratory to carry out tests, or as a conformity assessment body to carry out the initial assessment and other tests or inspections’.
- ‘Category C technical service’ means ‘the technical services which assess and carry out regular checks on the manufacturer’s procedures for checking the conformity of production’.
- ‘Category D technical service’ means ‘technical services which supervise or carry out tests or inspections for the surveillance of conformity of production’.
- ‘Declaration of conformity’ means ‘a declaration drawn up by the office or department within the manufacturer’s organisation which is duly authorised by the management to fully engage the legal responsibility of the manufacturer with regard to the design and construction of a vehicle’.
In detail
I. Application for initial assessment / COP
The manufacturer sends the application form for initial assessment / COP (see docs ‘Form évaluation initiale COP’ and ‘signatures’) by post (address: Boulevard du Nord 8, 5000 Namur) or email (email: homologation.vehicules@spw.wallonie.be) for the attention of the Wallonia Mobility and Infrastructure Public Service – Department of Transport Rules and Regulation – Department of Vehicle Regulation and Certification.
The application form must be duly completed and must also include:
- a list of the places of production;
- details of the regulations concerned;
- a list of serial/partial approvals already issued and/or approvals.
There are two pathways, depending on whether:
- The manufacturer has an ISO 9001 certificate: 2015 (or equivalent) or a declaration of conformity, in accordance with Regulation (EU) No 2018/858, issued by another authority. Generally, a category C technical service and, if necessary, the Directorate for Vehicle Regulation and Certification, will process the application.
As a minimum, the following documents will be checked when the file is processed:
- ISO 9001 certificate: 2015 / Declaration of conformity
- audit report
- skills matrix (see Annex 1)
- overview of equipment
- checklists
- a check of the inspection plans carried out by a category D technical service.
Observation: This check is documented in an audit report which is sent to the Directorate for Vehicle Regulation and Certification for further processing (in the case of a declaration of conformity, this is only necessary for regulations that do not fall within the scope of this declaration of conformity). If necessary, this check will be supplemented by an on-the-spot assessment; this will consist of a verification carried out at the premises of a technical service or of one of its subcontractors or subsidiaries.
- The manufacturer does not have an ISO 9001 certificate: 2015 (or equivalent).
In practice, the assessment is carried out by a category C technical service and a category D technical service.
This effectively means that:
- The initial assessment is carried out by a category C technical service. This technical service will carry out the assessment and send the report by post (address: Boulevard du Nord 8, 5000 Namur) or email (email: homologation.vehicules@spw.wallonie.be) for the attention of the Wallonia Mobility and Infrastructure Public Service – Department of Transport Rules and Regulation – Department of Vehicle Regulation and Certification.
- The check of the inspection plans is carried out by a category D technical service, which draws up an audit report and sends it by post (address: Boulevard du Nord 8, 5000 Namur) or email (email: homologation.vehicules@spw.wallonie.be) for the attention of the Wallonia Mobility and Infrastructure Public Service – Department of Transport Rules and Regulation – Department of Vehicle Regulation and Certification.
II. Existing partial/serial approvals
If the manufacturer already has e6/E6 approvals, it must mention this in the application for initial assessment / COF (see point 1).
Before accessing the WTAS (Wallonia Type Approval System), the manufacturer is required to have a COP check valid for e6/E6 approvals that have already been issued. The COP check must be carried out by a category D technical service.
III. Application for an extension
If necessary, the manufacturer may request an extension. This may relate to:
- the field of application,
- the place of production,
- the regulations.
Extension applications and processing are dealt with in the same way as the application for initial assessment / COP (see point 1).

Once the complete file has been submitted to the Directorate for Vehicle Regulation and Certification, this Directorate reserves the right to process the application within one month.

Pursuant to the laws on the Council of State of 12 January 1973, ‘an application for annulment (and possible suspension) of the decision may be lodged with the Council of State within 60 days of the notification or of the applicant’s knowledge of the contested measure. The appeal must be lodged by a dated and signed application sent by registered post to the registry of the Council of State, rue de la Science 33 à 1040 BRUXELLES ’.
Where appropriate, a complaint may be lodged with the joint mediation service of the French Community (Fédération Wallonie-Bruxelles) and the Walloon Region in accordance with Article 12 of the Cooperation Agreement entered into between them on 3 February 2011 on the creation of a joint mediation service, which was approved by decree of 31 March 2011.
