Does your company recover or recycle waste ?

You can apply for the recognition or registration of end-of-waste status from SPW Agriculture, Natural Resources and the Environment (ARNE).

End-of-Waste status offers significant practical and financial advantages in relation to taxes, transport and permits.


FROM PRODUCTION TO END-OF-WASTE STATUS

A producer creates products and production residues. These production residues can become either by-products or waste. A waste producer must engage a registered (non-hazardous) or approved (hazardous) collector to collect its waste. Once it has been collected, the waste can obtain end-of-waste status via recovery or recycling.

Companies may opt not to request the recognition or registration of end-of-waste status. In that case, the waste remains waste and the producer must continue to comply with the relevant legal obligations.


WHICH WASTE IS COVERED ?

Inert and non-hazardous waste are good candidates for end-of-waste status.

The application fee is EUR 500. Please contact us – the Waste Management Infrastructure and Policy Department (DIGPD) – to discuss your application before submitting it. There are a number of factors to consider (type of waste, similar applications, legislation, etc.).


RECOGNITION OR REGISTRATION ?

  • Recognition is obtained before waste is created and establishes criteria for a new flow, process or use. Once the recognition criteria have been established, end-of waste status will be registered on this basis, at no additional cost.
  • Registration applies if you believe that you are doing the same as another company whose criteria have already been recognised, or if you are carrying out an activity for which the government has already established the rules for obtaining end-of-waste status. See, for example, Annexes 1 and 2, setting out the criteria for end-of-waste status applicable to recycled aggregates and paper (available in french). SPW does not grant sector-wide registrations. Each individual company must apply for registration for each location.

 

I HAVE ALREADY BEEN GRANTED RECOGNITION BY ANOTHER EU COUNTRY/REGION

If you are a waste recovery company or have bought material from a waste recovery company abroad, within the European Union, and the Member State in question recognises the end-of-waste status of the material in question, you can provide evidence of this. If this decision ensures a level of environmental protection equivalent to that provided in Wallonia, it may also apply in Wallonia.

Please note: Our decisions are only valid in Wallonia!  You are responsible for confirming the validity of the recognition of end-of-waste status in other countries, especially when moving waste across borders.

Conditions

Four general conditions of end-of-waste status : 

1.    The material or product is intended to be used for a specific purpose
2.    There is a market or demand for the product
3.    The material or product meets technical requirements and complies with legislation/standards
4.    It has no overall harmful effects on human health and the environment


Requirements applicable AFTER obtaining recognition/registration :

  • A certificate of conformity
  • A quality management system certified by an independent body You must prove that :
    • You take every precaution in relation to inputs/processes
    • You avoid using hazardous waste as an input
    • You guarantee the quality of recycled materials
Procedure

WHAT DO YOU NEED TO DO ?

  3. Compile, complete and send us the documents required by post

If you have more than one location, you must submit one application per location.


APPLICATION FEES

An application fee of EUR 500 must be paid into the SPWARNE - SSD-SP account: BE30 0912 1502 7811. Reference: The name of the company and the flow concerned.


DOCUMENTS TO INCLUDE

Applications must be sent in hard copy. They cannot currently be submitted online. The application form below must be downloaded and printed. Applications can be completed in French or German.

Applications for the recognition or registration of end-of-waste status must include the following documents :

  • Application form (see ‘Forms’ below). Please send one paper copy to: SPW ARNE - DIGPD - Avenue Prince de Liège 15 - 5100 JAMBES.
  • Technical file (see template under ‘Useful documents’ below). This file may be submitted via email.
  • Receipt for payment. E-mail submission permitted.
  • Annexes (with table of annexes). E-mail submission permitted.

Applications for the recognition by the Walloon Region of a decision taken in another Member State or region of the European Union must include :

  • A copy of the decision and evidence showing that it ensures an equivalent level of environmental protection to recognition by the Walloon Region
  • Proof that the decision was notified to the Commission, where required
  • The evidence used to determine whether the applicable quality management system has been followed
  • The receipt for the application processing fee of EUR 500, paid to the bank account indicated by the administration
  • A French translation of decisions issued in another country, if originally in a language other than French or English


DEADLINES: APPLICATION FOR RECOGNITION

  • SPW Agriculture, Natural Resources and the Environment will determine whether the application is complete within 20 days.
  • We will make a decision on your application within the following 110 days.
  • We can request the opinion of the SPW Economy, Employment and Research department, which has 45 days to respond. If no response is received by this deadline, we will assume that the SPW EER’s opinion is favourable.
  • Our decision will be sent to you, published in the Belgian Official Gazette and made available to the public on our website.
  • Our decision will be valid for a maximum of 10 years
  • If we do not reach a decision by the deadline, the application will be deemed to have been rejected.
  • We can request the opinion of the reference laboratory, which has 45 days to respond. Once this deadline has passed, we will assume that the opinion of the reference laboratory is favourable.
  • We may also need to send the draft decision to the European Commission. In this case, the 110-day deadline is suspended during the European Commission consultation phase.

 

DEADLINES: APPLICATION FOR REGISTRATION 

If waste has already been recognised as having ceased to be waste, it is possible to apply for registration.

  • SPW Agriculture, Natural Resources and the Environment will determine whether the application is complete within 20 days.
  • We will make a decision on your application within the following 75 days.
  • Our decision will be sent to you, published in the Belgian Official Gazette and made available to the public on our website.
  • The validity of the registration is limited to the validity of the corresponding decision recognising end-of-waste status.
  • If we do not reach a decision by the deadline, the application will be deemed to have been rejected.


DEADLINES: APPLICATION FOR RECOGNITION OF A FOREIGN DECISION

  • SPW Agriculture, Natural Resources and the Environment will determine whether the application is complete within 20 days.
  • If any of the conditions is not met, we will inform you of the refusal of recognition within 75 days of receiving the application.
  • We will make a decision within 90 days of receiving your request.
  • The recognition period is limited to the period of validity of the corresponding decision to which this recognition applies and may not exceed 10 years.
  • You must notify us of any measures taken by the relevant authority in another EU Member State or region that revoke, suspend or amend the decision to which this recognition applies. Inform us within 20 days by registered letter or signed-for delivery.


APPEALS

You may appeal our decision. Appeals must be submitted within 20 days of receiving a decision or, if no decision is made, within 20 days of the deadline to issue a decision. Applications to appeal must be sent to the administration by registered letter or signed-for delivery.
